Im a bit confused by this article :) The bikes are made by Till Wolfer a German designer that works whit N55.
I think that it should be understood in the way that the the design plans are released under a CC, which are the only way in Denmark/Germany to allow others to share and modify the >design plans<. In Denmark/Germany you can not patent a bike design unless it is radical new. Whit out being a lawyer I would say that neither the bike and system used to build are old well known designs/technologies.
I found in my studies that when it comes to open sources hardware produced in Denmark, the product is often more a way to communicate, than entangled in legal rights.(This can of course be different from product domain – I have only investigated open source 3D printers, after 2005)
The purpose of XYZ Open City is also more of an artistic/philosophical, i think. The bike and the constructions are displayed at art museums and when I have been to there exhibitions they talk about new ways of making (societies).
